GUIDELINE ABOUT FIXATION OF REGULAR GOVT. SERVANT BS-16, ΑΡΡΟΙΝΤΜΕNT ON CONTRACT BASIS IN BS-17

This document from the Government of Punjab Finance Department addresses the issue of pay protection for government servants appointed on a contract basis and subsequently regularized:

Subject: Guidelines for the fixation of pay for regular government servants (BS-16) appointed on a contract basis in BS-17 (Headmaster) after April 5, 2013, and subsequently regularized on the same contract post.
Key Provision:
Pay protection for confirmed civil servants appointed on a contract basis in a basic pay scale was available under the Contract Appointment Policy, 2004, but this provision was omitted effective April 5, 2013.
Impact of Omission:
Cases of pay protection for contract appointments and subsequent regularisation before April 5, 2013, are covered by the old policy, while cases on or after this date are not and must be dealt with under Section 9 of the Punjab Regulations of Service Act, 2018, and relevant Supreme Court orders.
Conclusion:
The Finance Department does not confirm the viewpoint of the Accountant General, Punjab, regarding pay protection in specific cases falling after the April 5, 2013, cutoff.

I am directed to refer to your letter bearing No.73/PR-C/Pay Protection/2023-24/2754, dated 27.02.2024, on the subject cited above.

2. Finance Department has examined the case and observed that the provision of pay protection, in case of a confirmed civil servant who is appointed on a contract basis in a basic pay scale in government sector, was available vide para 3(XIII) (i)(e) of the Contract Appointment Policy, 2004. This provision was omitted w.e.f. 05.04.2013 vide Regulations Wing, S&GAD letter No. DS(O&M)5-3/2004/Contract (MF), dated 05.04.2013(copy enclosed). Meaning thereby, such cases of pay protection which fall under the period of contract and its subsequent regularization before 05.04.2013 are covered under the aforesaid provision and the cases which fall on or after 05.04.2013 are not covered under the same. As the case of Dr. Ejaz Mehboob, mentioned in the above referred letter, falls before 05.04.2013, he was entitled to the said benefit. Whereas, the under reference case falls under the period after 05.04.2013, therefore, this and all such cases shall be dealt under Section 9 of the Punjab Regulations of Service Act, 2018 and Order dated 08.07.2024 of Supreme Court of Pakistan in C.R.P. 30-1/2021 in C.P.L.A. 1641/2018, C.P.L.A. 1197/2023 (copy enclosed).

3. In view of the above, Finance Department does not confirm the view point of Accountant General, Punjab contained in Para 6 of the letter bearing No.73/PR-C/Pay Protection/2023-24/2730, dated 13.11.2023.
