Subject:- POLICY GUIDELINES REGARDING PENSIONARY MATTERS OF THE
RETIRED / RETIRING EMPLOYEES OF DEFUNCT DISTRICT COUNCILS NOW TEHSIL COUNCILS IN THE PUNJAB
The undersigned is directed to refer to the subject noted above and to state that District Councils have ceased to exist and succeeding Tehsil Councils have been constituted in terms of Section 3(2) read with Section 15 of the Punjab Local Government Act, 2019. Due to change of these institutions, references are being received in the department for issuance of necessary policy decision I directions to decide the pensionary matters of retired and retiring employees of Defunct District Councils.
2. Further directed to state that in order to avoid any ambiguity amongst the
newly constituted Tehsil Councils regarding pensionary matters, following guidelines are being issued in exercise of powers conferred under section 311(2) of PLGA 2019 to proceed further accordingly:
i. Local Council Servants retired prior to 07.11.2019 shall receive their
monthly pension from the Tehsil Councils of District Head Quarters.
ii. Local Council Servants of defunct District Councils appointed prior to 07.11.2019 and adjusted in Tehsil Councils shall also receive their pension, after retirement, from the Tehsil Council of District Head Quarter. However in such cases, the concerned Tehsil Council other than District HQ shall transfer monthly pension contribution regularly of its employees for the period they serve in that Tehsil Council to the pension funds of Tehsil Council of District HQ. The pension contribution so deducted w.e.f 07.11.2019 to-date by the respective Tehsil Council shall also be transferred to the pension fund of Tehsil Council of District HQ immediately without seeking any permission from LG&CD Department.
iii. Local Council Servants of respective Tehsil Councils appointed or to be appointed after 07.11.2019, pension contribution of those employees shall be deposited in the pension fund of the concerned Tehsil Council, where they are appointed.
iv. Leave encashment in lieu of LPR of all employees will be paid by the respective Tehsil Council from where the Local Council Servant will retire.
v. In case of death of any employee of a local government during his I her service, all approved benefits and financial assistance package as defined vide notification of Finance Department dated 15.08.2017 (adopted by LG&CD Department) shall be processed / paid by the respective Tehsil Council from where the Local Council Servant was posted 1 appointed.
3. The undersigned is further directed to clarify that the Administrators and
Chief Officers of the respective Tehsil Councils are authorized to exercise the power of Authority as stop gap arrangements in respect of employees of their concerned Local Governments from BS-12 and above and BS-01 to BS-11 respectively for the purpose of issuance of retirement order, payment of pension, sanction of leave and payment of other emoluments to be paid to retired Local Council Servants.
4. Further necessary action may please be taken accordingly strictly observing all codal, legal and procedural formalities.
