SEXUAL HARASSMENT CASE – OMBUDSPERSON RECOMMENDATIONS FOR RANA AZHAR IQBAL CEO DEA RYK

Ms. Asia Tasleem. Deputy District Education Officer, Liaqat Pur, District Rahim Yar Khan has filed harassment complaint against Mr. Rana Muhammad Azhar, Chief Executive Officer, District Education Authority Rahim Yar Khan under the Protection Against Harassment of Women at the Workplace Act, 2010 (amended up to date).
On last date of hearing, three witnesses belonging to Education Department appeared and got recorded their statements to support version of Ms. Asia Tasleem, Complainant has again complained (copy enclosed) that just after closure of court proceeding. the accused started severe harassment against her as well as her witnesses. Detail is as under:
i) Pension of one witness has been stopped by the accused.
ii) A show-cause notice has been issued to a witness on the same date of hearing i.e. 19.11.2020 on the pretext to resolve the issue mentioned in two years old writ petition.
iii) The other witness is being harassed telephonically through subordinates of accused and witness is being pressurized to withdraw his evidence through an affidavit.
iv) The complainant herself is being called frequently on the pretext of review meetings and being misbehaved during meetings.
According to section (4)(3)(d and e)
(d) adverse action shall not be taken against the complainant or the witnesses:
(e) the Inquiry Committee shall ensure that the employer or accused shall in no case create any hostile environment for the complainant so as to pressurize her from freely pursuing her complain, and
According to section 11 (schedule)(c)(x)
The employer shall do its best to temporarily make adjustment so that the accused and the complainant do not have to interact for official purposes during the investigation period.This would include temporarily changing the office, in case both sit in one office, or taking away any extra charge , over and above their contract.
