Teacher regularized in 2015 but included in Seniority list of 2009

ORDER
Mr. Fayyaz Ahmed, SST-Arts (CNIC No. 31101-1592013-3), Govt. High School Satellite Town Chishtian submitted an appeal seeking seniority with effect from 16.10.2009 as SST which was taken up by the undersigned for its consideration to decide under rules hence, the appellant was called for personal hearing alongwith relevant records on 08.5.2021 vide notice No. 86/Litigation dated 05.5.2021.
The appellant came up in this office and submitted that he has been rendering services for School Education Department being posted as SST at GHS Satellite Town Chishtian 13.12.2013. He further stated that during the Recruitment of Educators-2009, he had applied for the post of SST (Arts) but unfortunately some other candidate was appointed ignoring appellant’s merit cum eligibility while appellant was entitled for his appointment as SSE (Arts) with other badge mates. Feeling aggrieved, he filed Writ Petition No. 5113-2009 & Criminal Original No. 442-2013 which was accepted accordingly and he was appointed vide order No. 13073 dated 10.12.2013. Thereafter, the services of the appellant were regularized with effect from 07.8.2015 by the Department vide No. 13396-403/Admn (M) dated 15.12.2017. But, the appellant contended that he has been deprived from his legal right of seniority / appointment since 16.10.2009 (the date of joining of his budge mates). He also submitted that the misconception of the departmental authorities at the eve of Recruitment of Educators 2009, he has been suffered adversely which caused Ins lowest position in the seniority list of serving SSTs while his badge mates are enjoying the seniority and its fruits since 16.10.2009, hence he prayed for grant of seniority for redressal of his grievances.
In addition to above, it has also been brought in the notice of undersigned that my learned predecessor had also granted benefit of seniority to some SSTs who were appointed under the Recruitment Policy-2009, which strengthen the plea and contentions of the instant appellant.
After going through the contents of appeal, hearing his stance by comparing with the office records related to his matter and noticing the precedents presented by the appellant, undersigned has found nothing to differ with the contentions of the appellant therefore, under reference appeal of Mr. Fayyaz Ahmed, SST-Arts (CNIC No. 31101-1592013-3), Govt. H/S Satellite Town Chishtian for grant of seniority with effect from 16.10.2009, is hereby accepted accordingly.
